NIH has issued revised terms and awards for ARRA or Stimulus Awards. Please see NOT-OD-09-120 below or http://grants.nih.gov/grants/guide/notice-files/NOT-OD-09-120.html for further details. 

Important items to note: 

  1. If the ARRA award is an administrative supplement or competing revision to an existing (parent) award, then specific information on the additional ARRA funding must be included as part of the annual progress reports(s) for the parent grant.
  2. Quarterly reporting on ARRA awards will begin with the quarter ending September 30, 2009.
  3. Separate closeout documents (Final Progress Report, Final Financial Status Report, and Final Invention Statement) will be required to closeout ARRA funding at the time the ARRA funding ends.  These closeout reports for the ARRA funding are required even when the parent grant continues.

Recovery Act of 2009: Revised NIH Award Terms Available

Background

This Notice updates Notice NOT-OD-09-080 which first announced the use of HHS Standard Terms of Award applicable to all awards issued with funding provided by the American Recovery and Reinvestment Action of 2009 (“Recovery Act” or “ARRA”).  HHS has revised the Standard Terms and Conditions for awards issued with Division A  Recovery Act funds which will apply to all NIH grants and cooperative agreement ARRA awards.  Note, the reference to “Division A” reflects Division A—Appropriations Provisions of the ARRA; those that apply to NIH funding.

Revised HHS Standard Terms of Award

The approved terms for NIH ARRA awards as of the date of the issuance of this Notice are found at:  http://grants.nih.gov/grants/policy/NIH_HHS_ARRA_Award_Terms.pdf.   Each NIH ARRA Notice of Award (NoA) continues to include the following special term in Section III: 

ARRA TERM OF AWARD:  This award is subject to the HHS-Approved Standard Terms and Conditions for the American Recovery and Reinvestment Act of 2009.  Approved text for NIH awards can be found at: http://grants.nih.gov/grants/policy/NIH_HHS_ARRA_Award_Terms.pdf.  Recipients should pay particular attention to the special quarterly reporting requirements required by Section 1512 of the Recovery Act as specified in Term #2.

The key revision is term #2 on Recipient Reporting as required by Section 1512 of the Act.  The previous reference to the July 10, 2009 reporting date for the first recipient report has been removed.  In accordance with the OMB Guidance issued on June 22, 2009, the first quarterly recipient report will be submitted in October 2009.

These revised terms supersede the previous version dated March 2, 2009 and are applicable to all existing ARRA-funded awards; all ARRA awards issued on/after this date; all pending applications already submitted in response to ARRA-specific Funding Opportunity Announcements (FOAs); and any application to be submitted under an NIH ARRA FOA.

Any subsequent revisions to these terms will be posted at this same URL when available.

Revised NIH Term of Award for Administrative Supplements and Competitive Revisions

The NIH ARRA term for Administrative Supplements and Competitive Revisions (Type 3s) initially provided in Notice OD-09-080 has been revised to include an additional sentence reminding grantees that specific information on the ARRA additional funding must be included as part of the annual progress report(s) of the parent grant.  The full term included in Section III of all ARRA T-3s awards now reads:

ARRA Term of Award:  This award provides additional funding for [system to insert parent grant number].  This additional funding is provided under the American Recovery and Reinvestment Act of 2009 (ARRA) and is subject to the HHS-Approved Standard Terms and Conditions for ARRA. Approved text for NIH awards can be found at:  http://grants.nih.gov/grants/policy/NIH_HHS_ARRA_Award_Terms.pdf .  Recipients should pay particular attention to the special quarterly reporting requirements required by Section 1512 of the Recovery Act as specified in Term #2. These special quarterly reporting requirements apply only to this additional funding.  Recipients should not include any information about the parent grant when responding to the quarterly reporting requirements. 

Grantees are reminded to include specific information on the ARRA additional funding as part of the annual progress reports(s) of the parent grant.

Separate financial reporting (SF 272 and Financial Status Reports) will be required to be submitted covering this additional funding.  These will be in addition to any required financial reports for the parent grant.

Separate closeout documents (Final Progress Report, Final Financial Status Report, and Final Invention Statement) will also be required to closeout the Recovery Act funding at the time the ARRA funding ends.  These closeout reports for the ARRA funding are required even when the parent grant continues. 

ARRA funds provided under this award are not available for rebudgeting or carryover into the parent grant.  Any ARRA funding remaining at the end of the funding period for this award must be reported as an unobligated balance.
